MUTTr — Terms & Conditions

These Terms & Conditions (“Terms”) are a legal agreement between you and MUTTr LLC and its parent company, YAKKIT LLC (both being Delaware limited liability companies and both being referred to as “MUTTr,” “we,” “our,” or “us”) governing your access to and use of the MUTTr mobile application, website, and related services (collectively, the “Service”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What MUTTr Does (Entertainment Only)
MUTTr is an entertainment-only app which allows you to record an audio sample of your dog’s bark and then use the sample to generate a playful, synthetic “human-like” voice representation of your words. MUTTr does NOT translate animal speech, provide veterinary, safety, or behavioral advice, nor does it in any way communicate the actual intent or thinking of your pet. Do not rely on MUTTr in any situation where any injury, harm, or damage could occur.
2. Eligibility & Accounts
You must be [13/16/18]+ or have verifiable parental consent where required by law. You are responsible for maintaining the confidentiality of your device, login, and any content you create. You agree that all information you provide is accurate.
3. Subscriptions, Billing & Auto-Renew
We offer free and paid plans (e.g., MUTTr Basic, MUTTr Storybook, and annual variants). Paid plans are billed via Apple’s App Store or Google Play (“App Stores”). Subscriptions automatically renew unless canceled at least 48 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown on the renewal notification we send to you. Manage or cancel in your App Store account settings. Refunds are handled by the App Stores per their policies. Taxes may apply.
4. Recording Audio; Your Responsibilities
• Microphone access. The Service requires microphone permission to record your dog’s bark. On iOS and Android you will be prompted to grant permission before recording.
• Environment. Recordings may capture background sounds, including third-party voices or TV/audio. You are responsible for obtaining any necessary consents from people who may be recorded and for complying with applicable laws where you live.
• No illegal or harmful use. Do not use MUTTr to harass, defame, impersonate others, violate privacy, or infringe rights (including voice rights, publicity, or IP).
5. Your Content; License to MUTTr
“User Content” includes audio you record, text you type, images/videos you attach, and outputs generated for you. You retain ownership of your User Content. You grant MUTTr a permanent, unlimited, worldwide, non-exclusive, and royalty-free license to host, process, transcode, and deliver User Content solely to provide the Service, troubleshoot, prevent abuse, and comply with law.
Output Files. Files created through MUTTr (e.g., MP3s, videos) are user-generated. You are solely responsible for their use, sharing, storage, and any consequences. MUTTr does not control where you distribute them and, accordingly, will not be responsible to you or any other person for any damages caused by your use, sharing, storage, etc., of the Output files. Please refer to Section 11 (Indemnity), below, which sets forth your liability to us in certain situations.
Model improvement (choose one):
• [Default] We do not use your identifiable User Content to train foundation models. We may use aggregated or de-identified data to improve quality and safety.
• [Opt-in] We may ask you to opt in explicitly to allow certain recordings/metadata to improve models; you can withdraw any time in Settings.
• [If you prefer never] We never use User Content for model training.
6. Acceptable Use
You agree not to: (a) reverse engineer or copy our software, or compete unfairly with MUTTr; (b) upload malware; (c) attempt to bypass technical or subscription limits; (d) use outputs for deepfakes/impersonation of real people; (e) use the Service for medical or safety-critical purposes; or (f) violate any law, including intellectual-property, privacy, and recording laws.
7. Third-Party Services
The Service may rely on third-party hosting, AI processing, analytics, and crash reporting providers, and provides share targets (e.g., social platforms, email, messaging). Your use of third-party services is governed by their terms and privacy policies. MUTTr is not responsible for third-party services or networks.
8. Intellectual Property
The Service (excluding your User Content) is owned by MUTTr and its licensors and protected by IP laws. You receive a limited, revocable, non-transferable license to use the app for personal, non-commercial entertainment per these Terms.
9. DMCA & IP Complaints
If you believe content accessible through the Service infringes your copyright, send a notice to our DMCA agent:
Include all elements required by 17 U.S.C. §512(c)(3). We may remove content and, where appropriate, terminate repeat infringers.
10. Safety, Disclaimers, and Limitation of Liability
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUTTr DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
MUTTr is not responsible for any files created through the app or for damages arising from their use, sharing, or distribution. You assume all risks associated with using the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUTTr, ITS AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL ASSOCIATED WITH OR RESULTING FROM YOUR USE OF THE SERVICE. Our aggregate liability for any claims, damages or lost profits, data or goodwill, etc., will not exceed the amounts you paid to MUTTr in the 12 months preceding the claim (or USD $50 if you used the free plan).
11. Indemnity
You agree to defend, indemnify, and hold harmless MUTTr from any claims, actions, expenses, costs and other liabilities (including arbitration or court costs and reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
12. Termination
You may stop using MUTTr at any time and can delete your account in the app (or by contacting us). We may suspend or terminate access for violations of these Terms, abusive behavior, fraud, or legal risk. The sections set forth in these Terms that by their nature should survive (including, but not limited to, section 5 and sections 8 through13) will survive termination for an unlimited period of time.
13. Changes
We may update these Terms. If changes are material, we will provide in-app notice or email. Continued use after the effective date of any such changes constitutes your acceptance of them.
14. Governing Law; Dispute Resolution
These Terms are governed by the laws of Delaware, without regard to conflict of laws.
